Agreement of homepage utilization

The first chapter General Rules
First Amendment (Purpose)
This agreement aims at providing every necessary service's(sequentes 'service') condition of utilization, procedure, K-MDS and user's right, duty, responsible contents etc. that K-MDS offer.
Second Amendment (Effect and alteration of terms)
① This agreement is effective only if it is announced through K-MDS online service or other proper ways.
② K-MDS can change this agreement's content without announcement if there are inevitable situations and the changed content  will only be effective if it is announced like  ① section.
③ A member can ask for member withdrawal if they do not agree with the changed agreement and if he/she keeps on using the service after the effective date of policy, the member is defined as consenter to the new agreement.
Third Amendment (Rule apart from agreement)
Contents that are not indicated in this agreement follows Framework Act on Telecommunication, Telecommunications Business Act, communication network of information encouragement and other related legislation's rule.
Fourth Amendment (Term definition)
Major terms used in this agreement is illustrated below.
1. General member : Person who made a K-MDS service use contract and received an ID.
Nonmember : Person using the service without sign-up
2. System administrator : Person who K-MDS appointed to manage general services and administer smoothly
The Second Chapter Conclusion of Service use
Fifth amendment (Validation of utilization contract)
① Users who selected "agree" at the sign-up page are considered as consenter of this agreement. The circumstances are same when the agreement changes and if the user did not agree with the changed agreement, the member cancellation is possible.
② Utilization contract is valid after the agreement of the service use wisher with the contract and the approval from K-MDS.

Sixth Amendment (Application for utilization)
People who wants to sign-up as a member to use the service, they have to request by recording prescribed sign-up request form from K-MDS.
Seventh Amendment (Approval on application for utilization)
① For utilization application on the sixth amendment, K-MDS gives permission in order depending on their request time unless there are special reasons.
② K-MDS can deny the utilization application for the following situation and can not get their approval until their problems are solved.
1. When there is no space on service facilities
2. When there is a technological problem
3. Cases when the deny is decided as necessary because of K-MDS's situation
③ Denial of the utilization application is possible when K-MDS recognized the following cases.
1. When the requester did not request with their own name
2. When the requester used different person's name
3. When the utilization application request's required column are filled untruthfully
4, When the requester's purpose is an offense against public morals and disturbs the stabliilty of a society
5. When utilization application request is incomplete which is decided by K-MDS
④ When the request is reserved or denied because of section ② or section ③,  K-MDS has to inform the users about it. However, cases when K-MDS can not inform the users because of K-MDS's attributable reasons are exception.
Eighth amendment (Protection on personal information)
① K-MDS respects and protects members' personal information.
② K-MDS is doing its best to protect the received personal information from the service using members. Therefore, the personal information protection policy based on Protection of Communications Secrets Act, Telecommunications Business Act, promotion of information and communication network use, and other related legislations are made up to obey. Detailed information is at K-MDS personal information protection policy.
③ K-MDS collects member information during the process when the members provide information on their application for utilization, community activity, various event participation, and other utilization process, and the member's personal information is only used for the purpose of contractual service illustrated in this agreement
④ K-MDS can not share or use the member's information received, because of the service use, commercially without permission to him/herself except for the cases below.
1. If it is necessary for the payment of fee caused by telecommunication service
2. If it is necessary for personal identification for statistics producing process, academic research or marketing research
3. If there is a request from the concerned organs according to related Act and subordinate statute for rhetorical purpose by definite method
4. If there is a special rule for different legislation
5. If there is a request from Korea Communication Standards Commission
⑤ K-MDS can send a cookie to member's computer through service. Member can refuse the cookie reception or set-up the browser to warn the member when the cookie comes
Ninth amendment (Change in contract)
① Member can always look and edit their information through personal information setting
② Member must edit their information provided in application for utilization online if it has changed, and all the responsibilities due to unchanged information exist to the member
Third Chapter K-MDS and member's rights and duty
Tenth amendment (K-MDS's duty)
① K-MDS has a duty to provide a stable and safe service except for the cases below
1. If the service stop is inevitable because of service equipment maintenance, surveillance test, or construction
2. When the key telecommunications business operator prescribed by Telecommunications Business Act has stopped the service
3. When there is a matter of grave concern about war, incident, nature disaster or similar state of national emergancy
4. If there is a problem for service use because of facilities error or login flood
② K-MDS must handle the member's opinion's raised through fixed procedure, and should notice the member about the reason and the schedule for the time required and the schedule
Eleventh amendment (Member's duty)
① Member must obey the relevant Act and subordinate statute, this agreement's rule, operation guide, cautions announced through service, K-MDS's announcement, and do not disturb K-MDS's business
② Member can not do any promoting profit by using the service and distribute datas that are against law without K-MDS's prior consent
③ Member has responsibility on the maintanence of their ID and pin. Member takes total responsibility of all the results occurred because of the usage of his/her ID and pin. Also, he/she must notice K-MDS right away when their ID and pin are used without permission of oneself and if they didn't, all the problems occurred because of not noticing K-MDS are member's responsibility.
④ Member must not do any service related actions illustrated below.
1. Providing or using information received during service use to others by copying, duplicating, changing, publishing, broadcasting, and other method without K-MDS's previous consent
2. Actions that harms the social order by uploading pornography or linking pornographic site
3. Actions that damages or insults others' honor, violating others' intellectual property right, and violating other's rights
4. Hacking or spreading computer virus and constantly sending same advertisement to others who does not want it
5. Illegally using other member's ID
6. Collecting and saving other user's personal information
7. Impersonating others including K-MDS workers and administrator
8. Faking the addresser of sent contents through service
9. Stalking and harassing others
10. Actions that is concerned to disturb service management, and other violations on relevant Act and subordinate statute
Twelfth amendment (Exemption provision)
① K-MDS does not guarantee the accuracy and reliablility of the sent information, data, and fact that the member published through service and does not take responsibility on the losses caused by member's choice on service data.
② K-MDS does not take responsibility on the losses caused by the data through service and  the member's expectation of profit earned through service
③ K-MDS does not have duty to intervene the dispute between members or third person because of the service and has no responsibility to pay for damage done by this dispute.
④ K-MDS's responsibility is exempted from errors caused by the member's attributable reason during member's service use.
⑤ If there is a loss to K-MDS because of the violation on this agreement by the member, the member who violated this agreement has to compensate all losses and exempt K-MDS about the loss.
Thirteenth amendment (Indemnification for damage)
K-MDS does not take responsibility on member's losses by service supply from K-MDS under any circumstances unless K-MDS has made a gross negligence.
Fourteenth amendment (Prohibition of transfer)
Member can not transfer or give the service use authority and other authority on service usage to others and also can not provide authority as a mortgage.
The Fourth Chapter Utilization of Service	
Fifteenth amendment (Service use range)
Member can use the service provided within K-MDS site by the ID issued during K-MDS sign-up. However, there is exceptions when the related company provides contents separately
Sixteenth amendment (Providing information)
K-MDS can provide various information to the member through announcement and e-mail if the information is necessary for member's service use.
Seventeenth amendment (Contents charge)
① Services produced by K-MDS are basically free, but the specified fee has to be paid for the usage of charged services and informations.
② The range and price list will be posted later when using charged information servies.
Eighteenth amendment (Member's post)
K-MDS can delete the post upload by member without previous warning if the situation is concluded to the following circumstance
1. If the post is a content insulting or a slander to other member' and third person's rights
2. If the content violates public order and traditional custom
3. If the content is agreed that it colligate crime
4. If the content infringe K-MDS's copyright, third person's copyright, and other rights
5. If the content exceed the capacity of data or time K-MDS defined
6. If the content includes pornography or linkage to pornography site
7. If the content encourage illegal duplication or hacking
8. If the advertisement's purpose is profit
9. If the content does not corresponds to the bulletin board's nature
10. If the content is judged as a violation to other relevant Act and subordinate statute
Nineteenth amendment (Posting's copyright)
The rights about the data appeared at the service is illustrated below.
1. The responsibility and rights for the post stays to the poster and K-MDS can not use the post for profit purpose unless there is an agreement from the poster. But, non-profit cases are not like that and K-MDS also gets the publication within this service
2. Member can not use the information received from the serivce to sell, manufacture, etc. commercially
Twentieth amendment (Service hours)
① K-MDS opens the service immediately when the member's application for utilization is approved, but K-MDS has to post on service or notice the member if the service can not be open because of K-MDS's business and technique error.
② Service usage make it a rule to open year round 24 hours. However, the whole or part of the service can be temporally stopped due to K-MDS's business and technical problem and can also be stopped by operation process. For cases like this, K-MDS announces it before or after maintanence.
③ K-MDS can decide the service hours for each service and for this cases, K-MDS announces the alternations.

Twenty first amendment (Service offer stop)
For free service, all or part of the main service can be edited or stopped by K-MDS's need and in this case, K-MDS notices members through e-mail or internet homepage immediately.
The Chapter Five Contract cancel and restriction on service use

Twenty second amendment (Member withdrawal and use limitation)
① If a member wants to withdraw from the membership, him/herself has to request for member withdrawal to the member information management within K-MDS site.
② K-MDS can cancel the utilization contract without warning or shut down the corresponding member's service usage for fixed time when the member do the following actions
1. Actions that violate public rule and traditional custom
2. Actions related to crime
3. Actions or plans on service usage to hinder national development and public interest
4. Illegal usage on others' ID and pin
5. Cases when the registered name is not a real name
6. Actions harming or giving disadvantages to other's right
7. When the same user double registered  with different ID
8. Actions hindering healthy usage and causing harm to the service
9. Spreading computer virus programs that cause telecommunication facilities' malfunction and destruction
10. Violation on condition of utilization from other related statute that K-MDS defined

Supplementary provision
1. (Enforcement date) This agreement starts from January 1st 2020

Collecting and using personal information

[Purpose of collecting personal information]
K-MDS is collecting personal information for the following reasons.
a). Service provision according to K-MDS
- Managing department's education business request, agreement progress with selected department, education progress inquiry, request on target of education, and education monitoring
b). Member management
- Identification by membership system service use and restrictive real name system
- Prevention on illegal and unauthorized usage of illegal members
- Confirmation on sign-up, sign-up and restriction on number of times of signing up
- Record reserving for grievance mediation, complaint handling, and delivering civil complaint and matters of notification
c). Appliation on K-MDS's management improvement and supplementation
[Period of possession for personal information]
o Principals of personal informations are destroyed as a general rule after the fulfillment of personal information collection and usage purpose. However, the information is preserved for defined time if the case is like the following.
a). Information preserve reason by the company's inside policy
- Reason for preservation: Prevention amplification of the government's employment support business
- Preserved time :Permanent
b). Information preserve reason by related statute
- If the information are considered to be preserved by the legislation of consumer protection law in commercial law, e-commerce and etc., member information are preserved for steady time defined by the related statute상법,

 Reason for preservation : Legislation about consumer protection law in e-commerce etc.
 Preserved time : 5 years
- Record about production like payment and goods etc.
 Reason for preservation : Legislation about consumer protection law in e-commerce etc.

- Record about consumer's dissatisfication or settlement of disputes
 Reason for preservation : Legislation about consumer protection law in e-commerce etc.
 Preserved time : 3 years
[Authority on denial of personal information collect]
 K-MDS is acquiring additional information besides the basic information to offer more smooth service use, additional information is only applied when the service is provided, and it is not collected if source of the information says no with absoultely no disadvantages of denial.
  - Collecting additional information : English name, office phone number, office fax number
